These Terms of Service govern your use of the StaxAI platform. By creating an account or using any StaxAI tool, you agree to these terms. Please read them — they are written in plain language and explain your rights and ours clearly.
StaxAI is operated by Strategic Solutions (ABN 52 634 683 467). References to "StaxAI", "we", "us", and "our" mean Strategic Solutions. References to "you" and "your" mean the person or business subscribing to the platform.
StaxAI is a software-as-a-service (SaaS) platform that provides AI-powered business tools for Australian small businesses. Tools are offered as individual monthly subscriptions and as bundled packages. The platform is designed to complement existing job management platforms — it is not a replacement for your existing systems.
The tools available include marketing and social media content generation, email summarisation, website chatbot, industry news digest, business intelligence, strategic planning, and document generation tools. Not all tools are available at all times — some are in development or pending launch. The current status of each tool is shown on the platform dashboard.
We provide the platform on a best-efforts basis for small and medium business use. StaxAI is not designed for use in high-stakes professional contexts where AI errors could cause significant harm, such as legal advice, medical decisions, or regulated financial advice.
You must provide a valid email address and create a secure password to use StaxAI. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at privacy@staxai.com.au if you suspect unauthorised access to your account.
The person who creates the account and enters into a subscription is the Account Owner. Account Owners have full access to all platform features, billing, and team management. There is one Account Owner per account — this cannot be transferred.
Each tool subscription covers up to 5 users on the same business account. The Account Owner can invite up to 4 additional team members. Team members are assigned a security level (Manager or Staff) that governs what they can access. The Account Owner is responsible for the conduct of all team members on the account.
You must be 18 years or older and have the authority to enter into a binding agreement on behalf of the business to create an account. By creating an account, you confirm this is the case.
StaxAI tools are available as individual monthly subscriptions or as bundled STAX packages (STAX3, STAX6, STAX All). Prices are listed on the pricing page and on each tool's information panel. All prices are in Australian dollars and are inclusive of GST where applicable.
Subscriptions are billed monthly in advance. Payments are processed by Stripe — a secure payment processor. StaxAI never stores your credit card details. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis until you cancel.
If a payment fails, Stripe will attempt to retry the charge. If payment cannot be collected after reasonable retry attempts, access to the affected tools may be suspended until payment is resolved. You will be notified by email before suspension occurs.
We may change subscription prices from time to time. We will give you at least 30 days written notice before any price change takes effect. Continued use of the platform after the effective date of a price change constitutes acceptance of the new price.
Monthly subscription fees are non-refundable except where required by Australian Consumer Law. If you cancel mid-month, you retain access until the end of the current billing period. We do not provide pro-rata refunds for unused days.
Subscribers on a STAX bundle plan may swap tools within their bundle at any time. The swap takes effect immediately — the new tool activates and the removed tool deactivates. The bundle price does not change as a result of a swap.
StaxAI offers a 14-day free trial for new subscribers. The trial gives you full access to the tools you have selected. No charge is made during the trial period.
To start a free trial, you must provide valid payment details. If you do not cancel before the trial period ends, your payment method will be charged the applicable subscription fee for the first full billing period.
Free trials are available once per business account. Creating multiple accounts to access multiple free trials is a breach of these terms and may result in account termination.
We reserve the right to modify or discontinue the free trial offer at any time. Trial offers made at sign-up are honoured for the duration of that trial regardless of subsequent changes.
You may use StaxAI only for lawful business purposes. You agree not to:
We reserve the right to suspend or terminate accounts that breach these acceptable use requirements, without refund.
All content you upload to StaxAI — documents, photos, business information, email data — remains your property. You grant StaxAI a limited licence to process, store, and use that content solely for the purpose of providing the platform services to you. This licence ends when you close your account.
We use your content to operate the platform on your behalf. This includes sending relevant content to Anthropic's AI API for processing (as described in our Privacy & Data Security Policy) and storing processed outputs in your account. We use anonymised, aggregated data (which cannot be linked to your identity) for platform improvement.
We do not sell your content, share it with third parties for their own use, use it to train AI models, or use it for any purpose other than providing the platform to you.
You are responsible for ensuring that content you upload to StaxAI does not infringe any third party's rights, does not contain confidential information belonging to third parties without their consent, and complies with all applicable laws. We are not responsible for user-generated content uploaded to the platform.
AI-generated content can contain errors, inaccuracies, or outputs that are not appropriate for your business. Always review AI-generated content before publishing, sending, or relying on it.
StaxAI generates content using Anthropic's Claude AI. The quality and accuracy of AI-generated content depends on the quality of the inputs you provide. AI output is a starting point, not a finished product.
Content generated by the AI tools using your inputs and business information belongs to you. You may use, edit, publish, and commercialise AI-generated outputs from StaxAI without restriction.
We do not warrant that AI-generated content is accurate, complete, suitable for any particular purpose, or free from error. You use AI-generated content at your own discretion and risk. StaxAI is not liable for any loss or damage arising from your use of AI-generated content, including content that is factually incorrect, misleading, or inappropriate.
StaxAI must not be used to generate content that constitutes legal advice, medical advice, financial advice, or any other regulated professional advice. Content generated by the platform is for general business marketing and operational purposes only.
If you subscribe to the AI Website Chatbot and embed it on your website, you become the data controller for any personal information collected from your website visitors through the chatbot (including names, email addresses, phone numbers, and enquiry details).
You are responsible for: (a) informing your website visitors that their data is being collected through the chatbot; (b) obtaining any consent required by applicable privacy law; (c) publishing a privacy policy on your own website that covers data collected by the chatbot; and (d) complying with all applicable privacy laws in relation to your customers' data.
StaxAI processes your customers' data as a data processor on your instruction. We store it in your account, display it to you in your chatbot dashboard, and do not use it for any other purpose. We do not contact your customers, add them to any list, or share their information with any third party.
If a dispute arises regarding data collected by your chatbot from your customers, that dispute is between you and your customer. StaxAI is not a party to that dispute.
StaxAI connects with third-party services including Gmail, Outlook, Google Drive, Meta (Facebook/Instagram), and Stripe. When you connect these services, you are also subject to the terms of service and privacy policies of those providers.
We are not responsible for the availability, security, or performance of third-party services. If a third-party service changes its API, terms, or availability in a way that affects StaxAI functionality, we will work to restore functionality as quickly as practicable but cannot guarantee timeframes.
You can disconnect any third-party integration at any time from the Settings page. Disconnecting a service removes StaxAI's access to that service and deletes the stored OAuth tokens from your account.
We aim to keep StaxAI available at all times but do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible. Unplanned outages will be communicated via in-platform notices as soon as practicable.
StaxAI's AI features depend on Anthropic's API. If Anthropic's service is unavailable, AI-powered features will be unavailable during that period. We are not liable for outages caused by third-party service providers.
Support is provided via email. We aim to respond to all support enquiries within 2 business days. Support is available in English during Australian business hours (Monday to Friday, 9am–5pm AEST).
StaxAI does not offer a formal Service Level Agreement (SLA) at this time. Enterprise customers requiring guaranteed uptime and response times should contact us to discuss custom arrangements.
The StaxAI platform — including its software, design, branding, AI prompts, and platform architecture — is the intellectual property of Strategic Solutions. You may not copy, reproduce, modify, or distribute any part of the platform without our written permission.
The StaxAI name, logo, and brand assets are registered or unregistered trademarks of Strategic Solutions. You may not use our brand assets without our prior written consent.
Nothing in these terms transfers any StaxAI intellectual property to you. Your use of the platform is a licence to use it, not an assignment of ownership.
To the maximum extent permitted by Australian law, StaxAI's total liability to you for any claim arising from your use of the platform is limited to the amount you have paid us in subscription fees in the 3 months preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, special, or consequential loss, including loss of profits, loss of revenue, loss of data, or loss of business opportunity, arising from your use of the platform.
Nothing in these terms limits liability that cannot be excluded under the Australian Consumer Law, including liability for death or personal injury caused by our negligence, or for breach of consumer guarantees.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You may cancel your subscription at any time via the Billing section of your Account Management page, which opens the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. You retain full access to the platform until that date. No refunds are provided for the remaining period.
We may suspend or terminate your account immediately if you breach these terms, engage in fraudulent or illegal activity, or if we reasonably believe your use of the platform poses a risk to other users or to our systems. Where termination is for a breach, we are not obliged to provide a refund.
We may also terminate the platform entirely with 30 days notice to all subscribers. In this case, we will provide a pro-rata refund for any unused subscription period.
On termination or cancellation, your access to the platform ceases at the end of the billing period. Your data is retained for 30 days following account closure and then permanently deleted, as described in our Privacy & Data Security Policy.
We may update these Terms of Service from time to time. We will notify you of material changes via an in-platform banner at least 14 days before they take effect. Minor changes (such as clarifications or corrections that do not affect your rights) may be made without notice.
The effective date at the top of this document reflects the most recent version. Your continued use of the platform after the effective date of any changes constitutes acceptance of the updated terms.
These Terms of Service are governed by the laws of New South Wales, Australia. You and StaxAI agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising from these terms or your use of the platform.
Nothing in these terms affects your rights under the Australian Consumer Law, which applies regardless of any choice of law provisions.
